1 ноября 2006 года, около 17:45, 40-летняя Эдриэнн была найдена мёртвой в своём офисе, расположенном на Манхэттэне. Её муж, Энди Острой, обнаружил её повешенной на простыне в ванной комнате[8][9]. Первой версией причины смерти было самоубийство[10].

6 ноября 2006 года СМИ сообщили, что полиция арестовала 19-летнего строителя Диего Пиллко (Diego Pillco), нелегального эмигранта из Эквадора, который признался в убийстве Эдриэнн Шелли. Диего сообщил, что совершил убийство, когда актриса пожаловалась на шум от строительных работ, которые он производил в помещении, расположенном этажом ниже[9].

Свой поступок обвиняемый объяснил тем, что у него «был плохой день»[11]. 14 февраля 2008 года Пиллко был признан виновным. According to an acquaintance, Pillco said after eight months he still owed a debt on the $12,000 he had paid to be smuggled into the US, and he lived in the basement of a building owned by his employer. One of Shelly's neighbors told reporters that Pillco's stare had made the neighbor feel uncomfortable when she walked past him.[26] Shelly's husband sued contractor Bradford General Contractors, which had hired Pillco.[27] The complaint alleged that Shelly would still be alive if the contracting firm had not hired him.[27] Ostroy also sought to hold the owners and management of the building liable for Shelly's murder.[27] According to a New York Post article, among other allegations, the complaint stated that "'Pillco was an undocumented immigrant...' as were his co-workers,[27] and that "it was in Bradford General Contractors' interest not to have 'police and immigration officials [called] to the job site' because that would have ground their work to a halt".[27] On July 7, 2011, the lawsuit was dismissed by Judge Louis York. The court determined that Ostroy had not established legal grounds to hold the contractor liable, writing "While this court sympathizes with [Ostroy's] loss, plaintiffs have not presented sufficient legal grounds upon which to hold Bradford ... liable for Pillco's vicious crime",[28] and that there was likewise insufficient evidence presented to find that either the building's management agents or its owners "had reason to believe that Pillco was a dangerous person who should not have been allowed to work at the premises"[28] in order to find them vicariously liable. Ostroy was said to be considering an appeal.[28]

Shelly fue hallada muerta colgada con una sábana sobre la bañera. La familia no daba crédito a que la mujer, que ni siquiera había dejado una nota, se hubiera quitado la vida. Como si de un caso de C.S.I. se tratase, la insistencia de la familia y el hallazgo de unas huellas en el cuarto de baño, que no correspondían a los zapatos que usaba la víctima, además de otros detalles como el de que la sábana no estuviera tensa, llevó a la policía a sospechar que se trataba de un montaje realizado por el asesino.

El ecuatoriano Diego Pillco, obrero de la construcción de 19 años, confesó el asesinato de Adrienne Shelly en una declaración por escrito y en cinta de video, dijo el fiscal adjunto Marit Delozier en la audiencia de comparecencia de Pillco en la Corte Suprema estatal. Se ordenó la detención de Pillco sin derecho a pago de fianza hasta una audiencia. Al parecer, el acusado discutió con Shelly después de que ésta se quejara de los ruidos que provenían de un apartamento situado debajo del suyo. Durante la discusión, el joven golpeó a la mujer dejándola inconsciente y después intentó aparentar que se trataba de un suicidio. La fiscal explicó que evidencias forenses indicaban que Shelly no murió a consecuencia del golpe recibido, sino a causa de una compresión del cuello. En 2008, Diego Pillco fue condenado a 25 años de prisión y cinco más bajo libertad vigilada por el asesinato de la actriz.
